ILR & British Citizenship

Indefinite Leave to Remain and British citizenship are separate later stages after qualifying UK residence. An initial visa does not automatically confer either status.

UK service model: this website provides general information only. Personalised UK immigration advice, legal fact-finding, instructions and application services are provided separately by an appropriately regulated UK immigration adviser or law firm. Request contact from the regulated UK partner →

Indefinite Leave to Remain

ILR is UK settlement. Eligibility depends on the visa route, qualifying period, continuous residence and the other settlement rules applicable to that route.

Naturalisation

An adult with ILR or settled status will usually need 5 years' UK residence and to have held settled status for 12 months before applying, alongside language, Life in the UK and good-character requirements.

British spouse

A person married to or in a civil partnership with a British citizen can be subject to different naturalisation timing rules; the full eligibility criteria still need to be met.

Long-term position

Settlement and citizenship

Naturalisation is discretionary and separate from immigration permission. Residence, absence limits, good character, language and Life in the UK requirements is confirmed at the point of application.

Key considerations: British citizenship is a separate application from immigration permission and is subject to the nationality requirements in force at the time.

Case screening

Check the facts before choosing the route.

Nationality, immigration history, family structure, English-language position, business/employment facts and intended long-term residence can materially change the answer.
